Privacy policy
How Byron Bay Buses collects, uses, stores and discloses your personal information, and how to access or correct it.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what we collect, why we collect it, who we give it to and what you can do about it.
1. What we collect
We only collect personal information that is reasonably necessary to quote for, provide and administer transport services. That is generally:
- Identity and contact details — name, email address, phone number, company or group name, country of residence.
- Booking details — pickup and drop-off addresses, travel dates and times, passenger numbers, flight numbers and itinerary information.
- Payment information — processed by our payment provider. We do not store full card numbers on our systems.
- Correspondence — the content of enquiries, emails and any documents you choose to send us.
- Website usage data — pages visited, approximate location derived from IP address, device and browser type, collected through analytics.
Sensitive information
Occasionally you may choose to tell us about a mobility requirement, a medical need or a dietary restriction so we can transport or cater for you properly. That is sensitive information under the Privacy Act. We collect it only with your consent, use it only for that booking, and do not retain it beyond what is needed to deliver and account for the service.
2. How we collect it
Directly from you, in almost every case — through the enquiry form on this site, by phone, by email, or in the course of arranging a booking.
We may also receive your details from the person who organised a group booking you are travelling on, from a third-party booking agent, or from a corporate client arranging transport for staff or delegates.
We collect website usage data automatically through cookies and analytics, as described below.
3. Why we collect it
- To prepare quotations and confirm bookings.
- To operate the service — routing, dispatch, driver instructions, meeting you at an airport.
- To take payment and issue tax invoices.
- To contact you about your booking, including changes and delays.
- To meet legal and regulatory obligations, including passenger transport, work health and safety, and tax record-keeping requirements.
- To handle complaints and insurance matters.
- To improve the website and understand which services people are looking for.
We do not add you to a marketing list because you made an enquiry. If we ever send you marketing, it will be because you opted in, and every message will carry an unsubscribe link.
4. Who we disclose it to
We disclose personal information only where it is necessary:
- Our drivers and operations staff — the details needed to run your booking.
- Other Waggie Group operators — where your booking is fulfilled by, or involves, another vehicle or brand in the group.
- Service providers — website hosting, email, payment processing, analytics and, where relevant to your itinerary, venues and accommodation providers.
- Insurers and legal advisers — where there is an incident, a claim or a dispute.
- Government and regulators — where we are required or authorised by law.
We do not sell personal information, and we do not disclose it to third parties for their own marketing.
5. Overseas disclosure
Some of our service providers store data outside Australia — principally website hosting, email and analytics providers with infrastructure in the United States, Singapore and the European Union.
Before disclosing personal information overseas we take reasonable steps to ensure the recipient handles it in a way consistent with the Australian Privacy Principles, as required by APP 8. Where an overseas recipient is not subject to laws substantially similar to the Privacy Act, we rely on contractual protections instead.
6. Cookies and analytics
A cookie is a small file a website stores in your browser. The cookies this site uses do not contain identifying information by themselves; they support basic site function and allow us to understand aggregate traffic patterns.
You can refuse or delete cookies through your browser settings. This website works with cookies disabled.
We use analytics to count visits and understand which pages are useful. IP addresses are anonymised. We do not use analytics data to identify individual visitors.
7. Security and retention
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. This includes encrypted connections to this website, access controls on booking systems, and limiting staff access to what each role needs.
No transmission over the internet is completely secure, and we cannot guarantee absolute security of information sent to us.
We keep booking records for seven years to meet Australian tax and corporate record-keeping obligations. Enquiries that do not become bookings are deleted within 24 months. Information we no longer need and are not required to keep is destroyed or de-identified.
If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.
8. Accessing and correcting your information
You can ask us for a copy of the personal information we hold about you, and ask us to correct anything that is wrong. Email bookings@byronbaybuses.com with "Privacy request" in the subject line.
We will respond within 30 days. There is no charge to make a request. If we refuse access or correction we will tell you why in writing and explain how to complain.
9. Children
We do not knowingly collect personal information directly from children under 18. Bookings involving school and youth groups are made by the school, organisation or a parent or guardian, who provides the details we need.
10. Complaints
If you think we have mishandled your personal information, contact us first at bookings@byronbaybuses.com or 0409 661 342. We will acknowledge your complaint within five business days and aim to resolve it within 30 days.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
11. Changes to this policy
We update this policy when our practices change. The current version is always on this page with the date it was last updated at the top. Material changes affecting existing customers will be notified by email.
